Accommodation Terms and Conditions
Last updated: 2026-10-25
These are the terms and conditions governing accommodation contracts for TON (the "Facility"), operated by BUPPHA Inc. (the "Company"). They are prepared with reference to the Japan Tourism Agency's Model Accommodation Terms and in accordance with the Ryokan Business Act (Act No. 138 of 1948). The Facility is licensed under the Hotel Business Act (license no.: Nagano Prefecture Saku Public Health Office Directive No. 08-Saho-11-24/長野県佐久保健所指令08佐保第11-24号). This page is an English-language reference; the Japanese version (宿泊約款) prevails in case of any discrepancy.

- Accommodation contracts and related contracts concluded between the Company and guests shall be governed by these Terms and Conditions. Matters not provided for herein shall be governed by laws and regulations or generally established custom.
- Where the Company agrees to a special arrangement that does not contravene laws, regulations or custom, that special arrangement shall prevail notwithstanding the preceding paragraph.
- In addition to these Terms and Conditions, the "Terms of Use," "Cancellation Policy," "Sauna Rules," "Fire and Open-Flame Rules" and other rules separately stipulated by the Company form an integral part of these Terms and Conditions.

- Nationality and passport number (for guests who are foreign nationals)

Article 3 (Formation of the Accommodation Contract)
- An accommodation contract is formed when the Company accepts the application described in the preceding Article, unless the Company proves that it did not accept the application.
- When an accommodation contract has been formed under the preceding paragraph, the guest shall pay, by the date specified by the Company, an application deposit determined by the Company, up to the amount of the basic accommodation charges for the period of stay (or for three days where the stay exceeds three days).
- The application deposit shall first be applied to the accommodation charges ultimately payable by the guest; where circumstances arise to which Article 6 or Article 18 applies, it shall be applied first to penalty charges and then to compensation, and any balance shall be refunded.
- If the application deposit is not paid by the date specified by the Company under paragraph 2, the accommodation contract shall cease to be effective, provided that the Company has notified the guest to that effect when specifying the payment date.
Article 4 (Special Arrangements Requiring No Application Deposit)
- Notwithstanding paragraph 2 of the preceding Article, the Company may agree to a special arrangement not requiring payment of the application deposit after the contract has been formed.
- Where the Company has not requested payment of the application deposit or has not specified its payment date when accepting an application, the Company shall be deemed to have agreed to the special arrangement described in the preceding paragraph.

- Where accommodation cannot be provided due to natural disaster, facility failure or other unavoidable causes.
- Where the case falls under the Nagano Prefectural Ordinance for the Enforcement of the Ryokan Business Act.

- If a guest cancels all or part of the accommodation contract for reasons attributable to the guest, the Company shall charge penalty fees in accordance with the separately stipulated "Cancellation Policy," provided that, where the Company has agreed to the special arrangement described in Article 4, paragraph 1, this applies only where the Company has informed the guest of the obligation to pay penalty fees upon cancellation.
- If a guest does not arrive by 8:00 p.m. on the day of stay without contacting the Company (or, where an estimated arrival time has been indicated in advance, by two hours after that time), the Company may treat the accommodation contract as having been cancelled by the guest.
Article 7 (Company's Right to Cancel the Contract)

- Payment of the accommodation charges referred to in the preceding paragraph shall be made in currency or by credit card, electronic money, traveler's check, accommodation voucher or other method accepted by the Company, at the time of the guest's departure or when requested by the Company, at the front desk or by the method designated by the Company.
- Accommodation charges shall be payable even where the guest voluntarily chooses not to stay after the Company has made a room available for the guest's use.
Article 13 (Liability of the Company)

Article 15 (Handling of Deposited Items)
- Where loss of or damage to goods, cash or valuables deposited by a guest at the front desk occurs, the Company shall compensate the damage unless caused by force majeure, provided that, in the case of cash and valuables, where the Company requested a declaration of their type and value and the guest failed to do so, the Company shall compensate the damage up to a limit of ¥150,000.
- Where loss of or damage to goods, cash or valuables brought into the Facility by a guest but not deposited at the front desk occurs due to the Company's intent or negligence, the Company shall compensate the damage, provided that, for items whose type and value were not declared in advance by the guest, the Company shall compensate the damage up to a limit of ¥150,000, except in cases of intent or gross negligence by the Company.
Article 16 (Storage of Guests' Baggage and Personal Effects)
- As the Facility is operated unstaffed, advance storage of baggage prior to a stay is not, in principle, accepted.
- Where a guest's baggage or personal effects are found left behind at the Facility after check-out and the owner is identified, the Company shall contact the owner and seek instructions. Where no instructions are given or the owner cannot be identified, the item shall be kept for seven days including the day of discovery and thereafter delivered to the nearest police station.
- The Company's responsibility for the storage of guests' baggage and personal effects in the cases described in the preceding two paragraphs shall conform to paragraph 1 of the preceding Article in the case of paragraph 1, and to paragraph 2 of the preceding Article in the case of paragraph 2.
Article 17 (Parking)
Where a guest uses the Facility's parking area, the Company merely lends the space, regardless of whether the vehicle key is deposited, and does not assume responsibility for the management of the vehicle, provided that the Company shall be liable for damage caused by its intent or negligence in managing the parking area.
Article 18 (Guest Liability)
- Where damage — including breakage, soiling, malfunction, loss or theft — is caused to the building itself or its structural elements (including walls, floors, ceilings, pillars, fittings, windows, plumbing areas, and water supply/drainage, electrical, air-conditioning and communications equipment), interior finishes, furniture, appliances, fixtures, equipment, bedding, tableware, decorative items, books, keys and key boxes, sauna equipment, fire-pit equipment, the parking area, garden, plantings or any other facilities or property of the Facility (collectively, the "Premises and Property") through the intent or negligence of a guest (including accompanying guests and any person the guest allows to enter the Facility, including daytime visitors; hereinafter the same in this Article), the guest shall compensate the Company for all costs required for restoration (including repair costs, parts, replacement costs, cleaning costs, costs of arranging substitutes, transportation and installation costs).
- Where, as a result of the damage described in the preceding paragraph, the Premises and Property cannot be used for a certain period due to repair or replacement, or the Company is compelled to suspend acceptance of bookings or cancel existing bookings, the guest shall compensate, in addition to restoration costs, the accommodation charges and other revenue the Company would otherwise have earned during that period (business interruption compensation) and the costs incurred by the Company in connection with the cancelled bookings.
- Where soiling exceeds the scope ordinarily anticipated in cleaning guest rooms and other areas (including soiling by vomit, bodily fluids or excreta; adhesion of paint, ink or hair dye; severe stains on or damage to bedding, sofas or carpets; tar or odor adhesion from smoking outside designated areas; indoor carry-in of oil, soot or ash from open fires or cooking; and abandoned spoiled food), the guest shall bear a special cleaning fee. The amount shall be determined by the Company according to the degree of soiling; in the case of smoking outside designated areas, it shall be ¥50,000.
- Where breakage, soiling, malfunction, loss or other damage occurs, the guest shall promptly report it to the Company upon discovery. The Company shall treat the Premises and Property as having been in normal and good condition at check-in; where damage that the Company reasonably determines to have occurred during the stay is discovered after the guest has left without reporting it, the damage shall be presumed to have occurred during that stay and the Company may claim the costs described in the preceding paragraphs from the guest. A guest may not avoid payment on the ground that the guest failed to report the damage or concealed it upon departure.
- The person who made the booking and all accompanying guests and visitors of the stay shall be jointly and severally liable for the costs arising under this Article.
- The amounts of the costs under the preceding paragraphs shall be calculated reasonably by the Company on the basis of objective materials such as estimates or invoices from repair contractors, purchase prices and photographs. Where no equivalent item exists for a damaged article, or where individual repair is not reasonable, the amount may be calculated on the basis of the new-item price of an equivalent article or the replacement price of the entire set to which the article belongs. Costs required for investigating or appraising the damage shall be borne by the guest.
- Before charging the costs under the preceding paragraphs, the Company shall notify the guest by email at the address provided, setting out the nature of the damage, the amount claimed and the materials on which it is calculated (photographs, estimates and the like). The guest may object by email or in writing within 7 days of the date the notice is sent. Where no objection is raised within that period, or where the Company, having considered the objection, still considers the claim appropriate, the Company may charge the costs under the preceding paragraphs to the credit card registered at the time of booking or any other payment method notified by the guest, through our payment service provider and without further approval, and the guest consents to this in advance. Where such payment cannot be made, or where the Company requests payment by invoice, the guest shall pay by the date designated by the Company (within 14 days of the invoice date). In the event of late payment, the guest shall bear late-payment interest at the rate of 14.6% per annum from the day following the due date and the costs incurred by the Company for collection (including attorneys' fees). The Company does not require a security deposit and does not place authorization holds beyond the amount necessary to settle the accommodation charges. Credit card numbers and other card details are handled by our payment service provider and are neither collected nor stored by the Company.
- For damage caused by intent or gross negligence, the Company may claim additional damages beyond the costs described in the preceding paragraphs.
- Details of the handling under this Article are governed by Article 10 of the separately stipulated "Terms of Use."
Article 19 (Accidents on the Premises; Disclaimer)
- Guests are responsible for their own health and safety and shall use the Facility and its grounds (including guest rooms, the sauna, bathroom, fire-pit area, terrace, parking area, garden and plantings; hereinafter the same in this Article) at their own risk, in accordance with the various house rules and the precautions posted or communicated by the Company.
- Use of the sauna, open flames (fire pit, wood stove, etc.), plumbing areas, stairs, steps, outdoor equipment and other amenities involves risks including burns, falls, drowning, overheating and carbon monoxide poisoning. Guests shall exercise particular caution when using them after drinking alcohol, when in poor physical condition or when having a pre-existing condition, and shall refrain from unreasonable use.
- Guests are responsible for the supervision and safety of accompanying minors, elderly persons, persons requiring care and pets.
- The Facility is located in a rural farming area, and depending on the season, insects (mosquitoes, bees, wasps, horseflies, stink bugs and other insects) and wild animals or birds may appear on the grounds or indoors. The Company takes reasonable measures such as pest control and cleaning; however, except in cases of intent or gross negligence by the Company, the Company shall not be liable for discomfort, stings, bites, allergic reactions, soiling of belongings or any other harm or damage caused by such creatures.
- Guests shall not enter areas that the Company designates as off-limits by posted notice or other guidance (including the garden at the rear of the building). Except in cases of intent or gross negligence by the Company, the Company shall not be liable for accidents or damage occurring in such areas.
- Except in cases of intent or gross negligence by the Company, the Company shall not be liable for accidents, injuries, illness, health damage, death, or loss of, theft of or damage to belongings suffered by guests or their companions on the Facility or its grounds.
- Where a guest becomes aware of a situation requiring an emergency response (sudden illness, injury, fire, etc.), the guest shall immediately notify the fire department, police or other relevant authorities and also contact the Company.
Article 20 (Consideration for Neighbors; Prohibition of Nuisance)
- The Facility is located in a quiet residential area. Guests shall give due consideration to the living environment of neighboring residents and shall refrain, particularly between 10:00 p.m. and 7:00 a.m., from playing music at high volume, speaking loudly indoors or outdoors, setting off fireworks or engaging in any other conduct that disturbs the neighborhood.
- Guests shall observe the Company's instructions regarding parking, waste disposal and other matters, and shall cooperate in maintaining good relations with the neighborhood.
- Any dispute arising between a guest and neighboring residents or other third parties shall be resolved by the guest at the guest's own responsibility and expense, except where caused by the Company's intent or negligence, and the Company shall bear no liability.
- Where a complaint is received from the neighborhood or elsewhere concerning use of the Facility and the Company deems continuation of the stay inappropriate, the Company may cancel the accommodation contract pursuant to Article 7 and require immediate departure. In such cases, charges already paid will not be refunded.
Article 21 (Security Cameras)
- For the purposes of crime prevention, accident prevention, ensuring guest safety and confirming compliance with these Terms and Conditions and the various house rules, the Company has installed security cameras and/or sensors outdoors, at the entrance and in shared areas of the Facility.
- No such cameras or devices are installed in guest rooms, the sauna room, bathroom, toilets or any other space where guest privacy must be respected.
- The Company may use footage recorded under paragraph 1 within the scope of the purposes described therein and as evidence for fact-finding and claims for damages in connection with breakage, noise, exceeding the guest limit or other rule violations. The handling of such footage is governed by the separately stipulated "Privacy Policy."
Article 22 (Prohibited Acts)
Guests shall not engage in any of the following acts when using the Facility. Details are governed by Article 8 of the separately stipulated "Terms of Use."
- Use by more persons than the declared number of guests, or allowing persons other than registered guests to enter or stay without the Company's approval
- Subletting all or part of the Facility to third parties, or using it for purposes other than accommodation (photography or filming, events, commercial use, sale of goods, etc.), except with the Company's prior written approval (including by email)
- Smoking anywhere on the Premises (inside or outside the building, including the grounds) other than in designated areas
- Bringing in dangerous goods (gunpowder, flammable gas, firearms, swords or other items prohibited by law)
- Nuisance, intimidation, harassment or any other conduct contrary to public order and good morals directed at other prospective guests, neighboring residents or the Company's staff
- Any other act the Company deems inappropriate for the operation of the Facility
Article 23 (Governing Law and Jurisdiction)
- These Terms and Conditions shall be governed by the laws of Japan.
- Any dispute arising between the Company and a guest in connection with these Terms and Conditions or an accommodation contract shall be subject to the exclusive jurisdiction of the Saku Branch of the Nagano District Court as the court of first instance.
Article 24 (Consultation)
Matters not provided for in these Terms and Conditions, or doubts arising as to their interpretation, shall be resolved through consultation between the Company and the guest in accordance with the principle of good faith.
