TON — Rules

Terms of Use

Last updated: 2026-10-10

These Terms of Use govern reservations for and use of TON (the "Facility"), an accommodation facility operated by BUPPHA Inc. (the "Company"). These Terms are the general terms for web reservations and use of the Facility; the details of accommodation contracts under the Ryokan Business Act are governed by the separately stipulated "Accommodation Terms and Conditions," which prevail in case of any conflict with these Terms. This page is an English-language reference; the Japanese version (利用規約) prevails in case of any discrepancy.

Article 1 (Scope of Application)

  1. These Terms apply to reservations for, stays at and use of other ancillary services of the Facility operated by the Company (address: 38-6 Yuhara, Saku City, Nagano 384-0307, Japan).
  2. These Terms apply to all users who make a reservation through the Facility's website, its booking pages or third-party booking sites (Airbnb, Booking.com, etc.).
  3. In addition to these Terms, the various rules separately stipulated by the Facility (Sauna Rules, Fire and Open-Flame Rules, Accommodation Terms and Conditions, Cancellation Policy, etc.) form an integral part of these Terms.
  4. These Terms, the Accommodation Terms and Conditions and the rules referred to in the preceding paragraph also apply, mutatis mutandis, to hourly use of the Facility without an overnight stay ("Day Use"). In that case, "stay", "period of stay" and "accommodation charges" shall read as "Day Use", "Day Use hours" and "Day Use charges" respectively. Cancellation fees for Day Use follow the same criteria as for overnight stays under the Cancellation Policy.

Article 2 (Definitions)

The terms used in these Terms are defined as follows:

Term Definition
Booker The person who has booked a stay at the Facility
User The Booker and any person staying at or using the Facility together with the Booker
Representative The adult who makes the reservation, payment and communications on behalf of the Users
Period of stay The period during which the Facility may be used under the reservation

Article 3 (Formation of a Reservation)

  1. Reservations shall be made through the Company's designated reservation form, a third-party booking site, or any other method designated by the Company.
  2. A reservation is formed when a reservation confirmation is sent by the Company or the booking site.
  3. The Booker shall enter true and accurate information when applying. A reservation made with false information may be cancelled at the Company's discretion.
  4. The Representative shall be at least 20 years of age and shall be present at the Facility during the period of stay.

Article 4 (Number of Guests and Companions)

  1. The maximum number of guests at the Facility is 12. Children aged 6 and under are treated as infants and are not counted in the number of guests (and stay free of charge).
  2. Children's accommodation charges are determined by the child's age on the date of stay: ages 7 to 12 are charged 60% of the adult rate; ages 13 and over are charged the same as adults.
  3. The Booker shall declare the names and age groups of all accompanying guests at the time of booking. Where children are included, please declare their ages for the purpose of calculating charges.
  4. Use by more persons than the number booked is prohibited. If discovered, the Company may charge additional fees or require that use of the Facility be discontinued.
  5. Where any person other than a registered guest (including daytime visitors) is to enter the Facility, the Company's prior approval shall be obtained.

Article 5 (Charges and Payment)

  1. Usage charges shall be paid in the amount, by the method and by the date designated by the Company or the booking site.
  2. Charges include the accommodation charge, cleaning fee, accommodation tax and any other fees separately stipulated.
  3. Where additional charges arise at the Facility (damage to equipment, special cleaning, costs arising from violations of these Terms, etc.), they will be invoiced afterwards.
  4. The reservation becomes final upon confirmation of payment.

Article 6 (Check-in and Check-out)

  1. Check-in time: 3:00 p.m.
  2. Check-out time: 11:00 a.m.
  3. If you wish to check in or check out outside the above hours, please consult the Company in advance. Availability depends on the bookings before and after your stay. No additional charge is made where accommodated.
  4. If your arrival will be significantly delayed, be sure to contact the Company in advance. If you do not arrive by the end of the day of stay without prior notice, the reservation will be treated as a no-show cancellation and penalty fees under the Cancellation Policy will be charged.

Article 7 (Keys and Security)

  1. Entry to the Facility is by the smart-lock / key-box code notified by the Company in advance.
  2. Do not disclose the code or any other entry information to third parties other than the Users.
  3. If a key or any equipment is lost or damaged, contact the Company immediately.

Article 8 (Prohibited Acts)

Users shall not engage in any of the following acts when using the Facility:

  1. Acts in violation of laws or regulations, these Terms, the Accommodation Terms and Conditions or the various house rules
  2. Use by more persons than the declared number of guests, or allowing persons other than registered guests to enter without approval
  3. Use for purposes other than accommodation (commercial photography or filming, events, commercial use, sale of goods, etc.) without the Company's prior written approval (including by email). Photography for personal, private social-media posts by Users is not subject to this restriction.
  4. Damaging, soiling or altering without approval the structure, interior, furnishings or equipment of the Facility
  5. Smoking anywhere inside the building (all indoor areas, including guest rooms, the sauna room, corridors and the entrance). Smoking is permitted outdoors only (on the wood deck and in the garden). No ashtrays are provided; use a portable ashtray and confirm that cigarette butts are completely extinguished. This applies to all cigarettes, cigars, e-cigarettes and heated tobacco products.
  6. Failing to comply with the pet rules separately stipulated by the Company (permitted areas, use of a leash, additional cleaning, etc.) when accompanied by a pet
  7. Playing music at high volume, speaking loudly or engaging in any other conduct that disturbs neighboring residents (particularly after 10:00 p.m.)
  8. Bringing in dangerous goods (gunpowder, flammable gas or other items prohibited by law)
  9. Use by organized crime group members, persons affiliated with organized crime groups or other anti-social forces, or use accompanied by such persons
  10. Acts contrary to public order and good morals, criminal acts, or acts likely to constitute either
  11. Nuisance, intimidation or harassment directed at other prospective guests, neighboring residents or the Company's staff
  12. Acts that obstruct the operation of the Facility
  13. Entering areas that the Company designates as off-limits by posted notice or other guidance (including the garden at the rear of the building)
  14. Any other act the Company deems inappropriate

Article 9 (Measures upon Violation)

  1. Where the Company determines that a User has engaged in, or is likely to engage in, any of the acts described in the preceding Article, the Company may, without prior notice, cancel the accommodation contract, require immediate departure, discontinue use of the Facility or take any other necessary measures.
  2. Charges already paid to the Company will not be refunded in connection with the measures under the preceding paragraph.
  3. Where a violation of these Terms causes damage to the Company or a third party, the User shall be liable to compensate that damage (including attorneys' fees).

Article 10 (Damage to Property and Compensation)

  1. Where damage — including breakage, soiling, malfunction, loss or theft — is caused to the building itself or its structural elements (including walls, floors, ceilings, pillars, fittings, windows, plumbing areas, and water supply/drainage, electrical, air-conditioning and communications equipment), interior finishes, furniture, appliances, fixtures, equipment, bedding, tableware, decorative items, books, keys and key boxes, sauna equipment, fire-pit equipment, the parking area, garden, plantings, neighboring houses or any other property or facilities (collectively, the "Premises and Property") through the intent or negligence of a User (meaning the Booker, accompanying guests and any person the User allows to enter the Facility, including daytime visitors; hereinafter the same in this Article), the User shall bear all costs required for restoration (including repair costs, parts, replacement costs, cleaning costs, costs of arranging substitutes, transportation and installation costs, and related expenses).
  2. Where, as a result of such damage, the Premises and Property cannot be used for a certain period due to repair, replacement or cleaning, or the Company is compelled to suspend acceptance of bookings or cancel existing bookings, the User shall bear, in addition to restoration costs, the accommodation charges and other revenue the Company would otherwise have earned during that period (business interruption compensation) and the costs incurred by the Company in connection with the cancelled bookings.
  3. Where soiling exceeds the scope ordinarily anticipated in cleaning guest rooms and other areas, the User shall bear a special cleaning fee. The amount is determined by the Company according to the degree of soiling:
    1. Soiling by vomit, bodily fluids or excreta
    2. Adhesion of oil-based paint, art paint, ink, hair dye, cosmetics, etc.
    3. Severe staining of or damage to bedding, sofas, carpets, etc.
    4. Tar or odor adhesion from smoking outside designated areas (special cleaning fee: ¥50,000)
    5. Indoor carry-in of oil, soot or ash from open fires or cooking
    6. Abandoned spoiled food or any other unsanitary condition left behind
  4. Where breakage, soiling, malfunction, loss or any other damage — or a risk thereof — arises with respect to the Premises and Property, the User shall report it to the Company (contact@ton-nagano.com) immediately upon discovery. The Company shall treat the Premises and Property as having been in normal and good condition at check-in; damage discovered after check-out that the Company reasonably determines, from its nature and circumstances, to have occurred during the stay shall be presumed to have occurred during that stay, and the Company may claim the costs under this Article from the User. A User may not avoid payment on the ground that the User failed to report the damage or concealed it upon departure.
  5. The Booker and all accompanying guests and visitors of the stay shall be jointly and severally liable for obligations under this Article. The Booker bears the same responsibility for the acts of persons the Booker allows to enter the Facility as for the Booker's own acts.
  6. The amounts of the costs under paragraphs 1 through 3 shall be calculated reasonably by the Company on the basis of objective materials such as estimates or invoices from repair contractors, purchase prices and photographs. Where no equivalent item exists for a damaged article, or where individual repair is not reasonable, the amount may be calculated on the basis of the new-item price of an equivalent article or the replacement price of the entire set to which the article belongs. Costs required for investigating or appraising the damage shall be borne by the User.
  7. Before charging the costs under this Article, the Company shall notify the User by email at the address provided, setting out the nature of the damage, the amount claimed and the materials on which it is calculated (photographs, estimates and the like). The User may object by email or in writing within 7 days of the date the notice is sent. Where no objection is raised within that period, or where the Company, having considered the objection, still considers the claim appropriate, the Company may charge the costs under this Article to the credit card registered at the time of booking or any other payment method notified by the User, through our payment service provider and without further approval, and the User consents to this in advance. Where such payment cannot be made, or where the Company requests payment by invoice, the User shall pay by the date designated by the Company (within 14 days of the invoice date). In the event of late payment, the User shall bear late-payment interest at the rate of 14.6% per annum from the day following the due date and the costs incurred by the Company for collection (including attorneys' fees). The Company does not require a security deposit and does not place authorization holds beyond the amount necessary to settle the accommodation charges. Credit card numbers and other card details are handled by our payment service provider and are neither collected nor stored by the Company.
  8. The Company may use security-camera records, records of the Facility's condition before and after check-in, photographs and other materials to establish the facts and as evidence for claims for damages. The Company may enter and document guest rooms and other parts of the Facility to the extent necessary to assess damage.
  9. For damage caused by intent or gross negligence, the Company may claim additional damages beyond the costs described in the preceding paragraphs. Nothing in this Article limits the Company's right to seek compensation for damage it has suffered.
  10. If you wish to use personal liability insurance or similar coverage in connection with damage, please consult the Company. The Company will provide documents to the extent necessary for dealing with the insurer.

Article 11 (Disclaimer)

  1. The Company may suspend or discontinue operation of the Facility due to natural disaster, epidemic, power or water outage, communications failure, administrative guidance or any other cause not attributable to the Company. In such cases, the Company's liability is limited to refunding the accommodation charges for the unused portion of the stay.
  2. The Company is not liable for loss of, theft of or damage to Users' belongings, except in cases of intent or gross negligence by the Company.
  3. The Company is not liable for accidents, injuries or health damage occurring within the Facility or on its grounds (including the parking area, garden, fire area and sauna), except in cases of intent or gross negligence by the Company.
  4. The Company is not liable for theft of or damage to vehicles in the parking area.
  5. The Facility is located in a rural farming area, and depending on the season, insects (mosquitoes, bees, wasps, horseflies, stink bugs and other insects) and wild animals or birds may appear on the grounds or indoors. The Company is not liable for harm or damage caused by such creatures, except in cases of intent or gross negligence by the Company.

Article 12 (Personal Information)

The Company handles personal information provided in connection with reservations and use of the Facility in accordance with the separately stipulated Privacy Policy.

Article 13 (Amendment of these Terms)

The Company may amend these Terms as necessary. The amended Terms take effect when posted on the Facility's website and apply to subsequent reservations.

Article 14 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by the laws of Japan.
  2. Any dispute arising between the Company and a User in connection with these Terms or use of the Facility shall be subject to the exclusive jurisdiction of the Saku Branch of the Nagano District Court as the court of first instance.

Article 15 (Consultation)

Matters not provided for in these Terms, or doubts arising as to their interpretation, shall be resolved through consultation between the Company and the User in accordance with the principle of good faith.
